These terms provide the operating rules for using MyCommercialManager. They should be professionally reviewed as the service and commercial offering develop.
The service
MyCommercialManager provides tools for creating, storing, submitting, acknowledging, tracking and exporting project Daily Records and related evidence. Features may be improved, changed or withdrawn as the product develops.
User responsibility
Users are responsible for the accuracy, completeness and lawful use of information they enter or upload, and for reviewing calculations, records and exports before relying on or issuing them.
Commercial and legal outcomes
The service assists with record keeping. It does not determine contractual entitlement, valuation, liability or the legal effect of an acknowledgement, and it does not provide legal, financial or professional advice.
Digital acknowledgements
An acknowledgement is tied to the record version, reviewer details, declaration and comments captured by the service. The effect of that action depends on the applicable contract, facts and law. Project users should select wording appropriate to their own process.
Acceptable use
Do not use the service unlawfully, interfere with its operation, attempt to access another organisation’s data, upload malicious content or store information you are not authorised to process.
Project data and exports
You retain ownership of project information you upload. You are responsible for maintaining appropriate copies and verifying exported information before use in another system or claim.
Availability and liability
The service is provided on an “as available” basis. To the extent permitted by law, no guarantee is made that it will be uninterrupted, error-free or suitable for a particular contractual or commercial purpose.
Changes and suspension
Features, these terms or access may be changed or suspended where reasonably required for security, maintenance, misuse, legal compliance or product development.
